Vendimi \u00ebsht\u00eb marr\u00eb pas k\u00ebrkes\u00ebs s\u00eb Prokuroris\u00eb Speciale t\u00eb Republik\u00ebs s\u00eb Kosov\u00ebs dhe mbajtjes s\u00eb seanc\u00ebs d\u00ebgjimore para gjyqtarit t\u00eb procedur\u00ebs paraprake.<\/p>\n

Sipas gjykat\u00ebs, ekziston dyshim i bazuar se dy t\u00eb pandehurit, n\u00eb bashk\u00ebkryerje, kan\u00eb kryer vepr\u00ebn penale t\u00eb p\u00ebrcaktuar n\u00eb nenin 142, lidhur me nenin 22 t\u00eb ish-Ligjit Penal t\u00eb ish-RSFJ-s\u00eb.<\/p>\n

Gjykata ka vler\u00ebsuar se paraburgimi \u00ebsht\u00eb i nevojsh\u00ebm p\u00ebr zhvillimin e papenguar t\u00eb procedur\u00ebs penale, pasi ekziston rreziku q\u00eb t\u00eb dyshuarit, n\u00ebse lihen t\u00eb lir\u00eb, t\u00eb pengojn\u00eb procedur\u00ebn, t\u2019i shmangen ndjekjes penale ose t\u00eb b\u00ebhen t\u00eb paarritsh\u00ebm p\u00ebr organet e drejt\u00ebsis\u00eb.<\/p>\n

Nj\u00eb nga arsyet e theksuara nga gjykata \u00ebsht\u00eb edhe fakti se t\u00eb dyshuarit jan\u00eb shtetas t\u00eb Serbis\u00eb, \u00e7ka, sipas vler\u00ebsimit t\u00eb saj, krijon rrezik konkret q\u00eb ata t\u00eb largohen dhe t\u2019i shmangen drejt\u00ebsis\u00eb.<\/p>\n
