Sot mbushen gjasht\u00ebmb\u00ebdhjet\u00eb vjet q\u00eb kur Gjykata Nd\u00ebrkomb\u00ebtare e Drejt\u00ebsis\u00eb (GJND) n\u00eb Hag\u00eb publikoi opinionin e saj k\u00ebshill\u00ebdh\u00ebn\u00ebs, sipas t\u00eb cilit deklarata e shpalljes s\u00eb pavar\u00ebsis\u00eb s\u00eb Kosov\u00ebs nuk ka shkelur t\u00eb drejt\u00ebn nd\u00ebrkomb\u00ebtare.<\/p>\n

Me dhjet\u00eb vota pro dhe kat\u00ebr kund\u00ebr, gjyqtar\u00ebt e Gjykat\u00ebs Nd\u00ebrkomb\u00ebtare t\u00eb Drejt\u00ebsis\u00eb m\u00eb 22 korrik 2010 vendos\u00ebn n\u00eb favor t\u00eb Kosov\u00ebs, duke hedhur posht\u00eb pretendimet e Serbis\u00eb se shpallja e pavar\u00ebsis\u00eb ishte n\u00eb kund\u00ebrshtim me t\u00eb drejt\u00ebn nd\u00ebrkomb\u00ebtare.<\/p>\n

Vendimi u lexua nga presidenti i at\u00ebhersh\u00ebm i Gjykat\u00ebs, Hisashi Owada, i cili deklaroi se “miratimi i deklarat\u00ebs s\u00eb pavar\u00ebsis\u00eb s\u00eb 17 shkurtit 2008 nuk ka shkelur t\u00eb drejt\u00ebn e p\u00ebrgjithshme nd\u00ebrkomb\u00ebtare”.<\/p>\n

Procesi n\u00eb GJND kishte nisur pas k\u00ebrkes\u00ebs s\u00eb Serbis\u00eb, e cila, p\u00ebrmes Asambles\u00eb s\u00eb P\u00ebrgjithshme t\u00eb Kombeve t\u00eb Bashkuara, k\u00ebrkoi nj\u00eb opinion k\u00ebshill\u00ebdh\u00ebn\u00ebs lidhur me ligjshm\u00ebrin\u00eb e shpalljes s\u00eb pavar\u00ebsis\u00eb s\u00eb Kosov\u00ebs.<\/p>\n

Opinioni i Gjykat\u00ebs u konsiderua nj\u00eb fitore e r\u00ebnd\u00ebsishme juridike dhe diplomatike p\u00ebr Kosov\u00ebn, pasi konfirmoi se e drejta nd\u00ebrkomb\u00ebtare nuk ndalon deklaratat e pavar\u00ebsis\u00eb. Pas k\u00ebtij vendimi, nj\u00eb num\u00ebr shtetesh njoh\u00ebn Republik\u00ebn e Kosov\u00ebs.<\/p>\n

Kosova shpalli pavar\u00ebsin\u00eb m\u00eb 17 shkurt 2008. Deri m\u00eb tani, Republika e Kosov\u00ebs \u00ebsht\u00eb njohur nga 118 shtete, nd\u00ebrsa vazhdon p\u00ebrpjekjet p\u00ebr an\u00ebtar\u00ebsim n\u00eb organizata nd\u00ebrkomb\u00ebtare dhe zgjerimin e njohjeve nd\u00ebrkomb\u00ebtare.<\/p>\n

Vendimi i 22 korrikut 2010 mbetet nj\u00eb nga momentet m\u00eb t\u00eb r\u00ebnd\u00ebsishme n\u00eb historin\u00eb juridike dhe shtetformuese t\u00eb Kosov\u00ebs, duke sh\u00ebrbyer si referenc\u00eb kryesore n\u00eb mbrojtjen e legjitimitetit t\u00eb pavar\u00ebsis\u00eb s\u00eb saj n\u00eb aren\u00ebn nd\u00ebrkomb\u00ebtare.<\/p>\n","protected":false},"excerpt":{"rendered":"
