ka hedhur posht\u00eb k\u00ebrkes\u00ebn e parashtruesve dhe nj\u00ebkoh\u00ebsisht ka refuzuar edhe k\u00ebrkes\u00ebn p\u00ebr vendosjen e mas\u00ebs s\u00eb p\u00ebrkohshme, e cila synonte pezullimin e afatit kushtetues p\u00ebr zgjedhjen e presidentit.<\/p>\n<p>Sipas vendimit, Gjykata ka urdh\u00ebruar q\u00eb ai t\u2019u kumtohet pal\u00ebve dhe t\u00eb publikohet n\u00eb Gazet\u00ebn Zyrtare, nd\u00ebrsa hyn n\u00eb fuqi menj\u00ebher\u00eb, n\u00eb p\u00ebrputhje me legjislacionin n\u00eb fuqi.<\/p>\n<p>Gjykata, nj\u00ebz\u00ebri, vendosi:<\/p>\n<p>I. T\u00cb HEDH\u00cb POSHT\u00cb k\u00ebrkes\u00ebn e parashtruesve t\u00eb k\u00ebrkes\u00ebs;<\/p>\n<p>T\u00cb REFUZOJ\u00cb k\u00ebrkes\u00ebn p\u00ebr vendosjen e mas\u00ebs s\u00eb p\u00ebrkohshme;<\/p>\n<p>&nbsp;<\/p>\n<p>III. T&#8217;UA KUMTOJ\u00cb k\u00ebt\u00eb Vendim pal\u00ebve;<\/p>\n<p>&nbsp;<\/p>\n<p>IV. TA PUBLIKOJ\u00cb k\u00ebt\u00eb Vendim n\u00eb Gazet\u00ebn Zyrtare t\u00eb Republik\u00ebs s\u00eb Kosov\u00ebs, n\u00eb pajtimme paragrafin 4 t\u00eb nenit 20 (Vendimet) t\u00eb Ligjit Nr. 03\/L-121 p\u00ebr Gjykat\u00ebn Kushtetueset\u00eb Republik\u00ebs s\u00eb Kosov\u00ebs;<\/p>\n<p>T\u00cb KONSTATOJ\u00cb q\u00eb ky Vendim hyn n\u00eb fuqi menj\u00ebher\u00eb, n\u00eb pajtim me paragrafin 5 t\u00eb nenit 20 t\u00eb Ligjit.<\/p>\n<p>&nbsp;<\/p>\n<p>K\u00ebrkesa n\u00eb Kushtetuese ishte dor\u00ebzuar nga Haxhiu nj\u00eb dit\u00eb pas nd\u00ebrprerjes s\u00eb seanc\u00ebs p\u00ebr zgjedhjen e presidentit t\u00eb ri, p\u00ebr shkak t\u00eb munges\u00ebs s\u00eb kuorumit.
